Application Guide of Study Residence Permit for Foreigners

I. Application for Residence Permit (extension)
Foreigners, who come to Chongqing to study, can apply to the exit-entry administration authority of the public security organ for a study residence permit. They shall be present for the interview in person, and submit the following materials as required:
1. Valid passport and visa.
2. Accurate-filled Visa/Stay Permit/ Residence Permit Application Form in black ink, a recently taken two-inch visa photo, and a valid Receipt of Exit-Entry Photograph gotten from a local photo studio authorized for digital exit-entry photographs.
3. An official Chinese letter stamped with the official seal from the school to the exit-entry administration authority of the public security organ, which shall include: 
(1) Basic information of the institution and the applicant;
(2) Purpose of application: including the studying contents in China, the duration of stay in China, and the entry-exit arrangement;
(3) Abidance by the Chinese legal securities; 
(4) If the residence permit is extended, the study attendance of the foreign student shall be indicated in the official letter.
4.Foreigners, who apply for residence permits in Chongqing for the first time, shall submit the Admission Notice or Enrollment Notice issued by the institution.
5. Foreigners, who apply for residence permits in Chongqing for the first time, shall submit the Foreign Student Visa Application Form (JW201/JW202) issued by the Chinese unit or the Registration Form for Foreign Students Studying in Chongqing issued by the Chongqing Municipal Education Commission.
6. Foreigners over the age of 18 who apply for residence certificates for the first time shall submit their health certificates issued by the domestic inspection and quarantine department within 6 months.
II. Application for Reissuance of Residence Permit
The foreigners can apply to the exit-entry administration authority of the public security organ for a re-issuance of residence permits due to certificate loss, damage, theft, or robbery. They shall be present for the interview in person. In addition to all the materials in the Application for Residence Permit, the following materials are also required:
1. For applicants whose residence permits are lost or stolen: a certificate of loss report of passport or a diplomatic note presented by their states’ embassies or consulates to China and a new passport.
2. For applicants whose residence permits are damaged: the damaged passport or a diplomatic note presented by their states’ embassies or consulates to China and a new passport.
III. Tips
1. Before applying for a foreigner’s exit-entry permit, it is required that the residence registration of foreigners has undergone in the residence places (in case of residence at the hotel, the residence registration should be handled at the reception, and in case of residence at places other than a hotel, the lodger or the applicant should handle the residence registration at the police substation of the residence place within 24h after arriving at the residence place), and it is unnecessary to submit the registration evidence.
2. The originals of all the application materials shall be submitted for inspection, with the copy kept (A4 paper).
3. In case the evidentiary material has been provided by the corresponding overseas organization, it is required to be authenticated by the Chinese embassy and consulate in a foreign country; in case the evidentiary material is in a foreign language, it should be translated into Chinese by a qualified translation company.
4. The personnel, who hasn’t canceled their Chinese household registration yet, shall re-apply after canceling it. The registered residence cancellation certificate issued by the relevant police officers should be submitted, when necessary.
5. To apply for an extension of the residence certificate period, an application shall be submitted 30 days before the expiration of the residence certificate.
6. If the registration items of the residence certificate are changed, the applicant shall apply for the change within 10 days from the date of the change and submit relevant certificates at the same time.
7. The schools shall promptly report to the exit-entry administration authority of the public security organ if they find that foreign students have dropped out of school or been expelled, violated the regulations of exit-entry management, or died or disappeared.
8. During the period when the passport or other international travel documents held by the applicant are kept for visa application, the applicant may legally reside in China within 15 working days with the acceptance receipt.
9. The unit issuing the invitation letter shall be responsible for the authenticity of the invitation content.
10. Foreigners holding study residence certificates, who need to practice outside the school, shall submit a letter issued by the institution and internship unit agreeing to practice outside the school, and apply to the exit-entry administration authority of the public security organ for annotation of the residence certificate.
11. In case overseas Chinese, who enjoy preferential visa policies (overseas Chinese include: foreigners who used to have Chinese nationality; parents or grandparents who have or had Chinese nationality), shall submit relevant certificates that they have or that their parents or grandparents have or had Chinese nationality (such as the original passport of People’s Republic of China (PRC), identity card, household registration certificate, household registration cancellation certificate, and certificate of the renunciation of PRC nationality); and those who have never had Chinese nationality shall submit the proof of kinship.
12. The teenager, whose parent(s) is(are) Chinese and who is less than 18 years old and applies for a visa document with a foreign passport, should submit the original and a copy of his birth certificate (an overseas certificate should be authenticated and translated), a copy of the foreign passport of the foreign parent(s) as well as the original and a copy of the identity certificate of the Chinese parent(s); in case a teenager was born at abroad, the original and a copy of the Chinese passport and visa or permanent residence certificate of the Chinese parent(s) at the time of his birth should also be submitted. For a teenager who has been confirmed as having Chinese nationality, no visa will be issued, but an exit-entry permit of the People’s Republic of China can be handled according to the relevant provisions.
13. The exit-entry administration authority of public security organ can verify the authenticity of the purpose of application through the interview, telephone inquiry, on-site investigation, etc., or requires that other supplementary materials (economic source certificates, certificates on changes of name or other information, enterprise business certificates, etc.) are submitted. In case the interview isn’t accepted or the materials are not submitted at the agreed time, no visa document will be signed and issued unless there are causes of force majeure.
14. Decisions made by the exit-entry administration of public security organ on rejecting applications for visa extension or re-issuance, or on not issuing foreigners’ stay or residence permits, or not extending the duration of residence shall be final.
IV. Completion Time Limit
The procedure shall complete within 15 workdays upon complete and eligible materials (excluding investigation time).
Ⅴ. Charging Standard:
(1) Residence permit valid within one year: 400 yuan;
(2) Residence permit valid for one year (including) to less than three years: 800 yuan; 
(3) Residence permit valid for three years (including) to five years (including): 1000 yuan.

外国人来渝申请学习类居留证件须知
1.居留证件申请(延期)
外国人来渝学习,可以向公安机关出入境管理部门申请学习类居留证件,本人须到场回答有关询问,按照规定要求提交下列材料:
1.有效护照及签证。
2.使用黑色墨水笔填写准确的《外国人签证证件申请表》,提交一张近期两寸半身正面免冠照片并出具出入境证件照片检测采集回执单(须在具有重庆市出入境证件数字照片采集检测条件的相馆拍摄照片并领取回执单)。
3.院校致公安机关出入境管理部门加盖公章的中文公函,内容应包括:
(1)院校和申请人基本情况;
(2)申请事由:包括来华学习内容、在华停留期限,以及出入境行程安排;
(3)遵守中国法律担保;
(4)留学生系居留证件延期的,公函内需注明留学生的学习考勤情况。
4.首次在渝办理居留证件的,提交院校出具的《录取通知书》或《入学通知书》。
5.首次在渝办理居留证件的,需提交《外国留学生来华签证申请表》(JW201/JW202表)或市教委出具的《來渝学习外国学生登记备案表》。
6.18周岁以上首次申请居留证件的外国人,提交国内检验检疫部门6个月内出具的身体健康证明。
二、居留证件补发申请
外国人因所持居留证件遗失、损毁或者被盗抢,可以向公安机关出入境管理部门申请补发居留证件。本人须到场回答有关询问。除提交《居留证件申请》中的所有材料之外,还需提交以下材料:
1.居留证件遗失或者被盗抢的,应提交新护照、本人护照报失证明或者所属国驻华使领馆照会。
2.居留证件损毁的,应提交新护照、出示损毁护照或者提交所属国驻华使领馆照会。
三、温馨提示
1.在申请签证证件之前,须已在住宿地进行外国人住宿登记(在旅馆住宿的,在旅馆前台办理住宿登记。在旅馆以外场所住宿的,留宿人或本人须于抵达住宿地24小时内向住宿地公安派出所办理住宿登记),不需提交登记凭证。
2.申请材料均交验原件并留存复印件(A4纸)。
3.证明材料系境外相应机构提供的,需经我国驻外使领馆进行认证;证明材料系外文的,需经有资质的翻译公司翻译成中文。
4.未注销中国户籍的人员,应注销户籍后再提出申请,必要时提交相关派出所出具的户籍注销证明。
5.申请延长居留证件期限的,应在居留期限届满30日前提出申请。
6.居留证件登记事项发生变更的,申请人应当自发生变更之日起10日内申请办理变更,同时提交相关证明。
7.院校发现外国留学生退学或被开除、违反出境入境管理规定、或出现死亡、失踪等情形的,应当及时向公安机关出入境管理部门报告。
8.申请人所持护照或者其他国际旅行证件因办理签证证件被收存期间,15个工作日内可以凭受理回执在中国境内合法居留。
9.出具邀请函件的单位应当对邀请内容的真实性负责。
10.持学习类居留证件的外国人,需要在校外实习的,应当提交就读院校和实习单位出具的同意校外实习的函件,向公安机关出入境管理部门申请居留证件加注。
11.涉及享有更优惠签证政策便利的外籍华人(外籍华人包括:曾经具有中国国籍的外国人;父母、(外)祖父母具有或曾具有中国国籍的外国人),应提交本人曾具有中国国籍的相关证明或其父母、(外)祖父母具有或曾具有中国国籍的相关证明(如原中华人民共和国护照、身份证、户籍证明、户籍注销证明、中华人民共和国退籍证书等);本人从未具有中国国籍的,还需提交亲属关系证明。
12.父母双方或一方为中国人的且未满18周岁的未成年人,持外国护照在华首次提出签证证件申请的,需提交本人出生证(境外的需认证和翻译)原件及复印件、外籍父(母)的外国护照复印件,中方父(母)身份证明原件及复印件,未成年人出生在境外的还需提交未成年人出生之时中方父(母)中国护照及签证或永久居留证明等原件及复印件。若经认定具有中国国籍的,不予签发签证,可按相关规定办理中华人民共和国出入境通行证。
13.公安机关出入境管理部门可以通过面谈、电话询问、实地调查等方式核实申请事由的真实性,或要求提交其它补充材料(经济来源证明、姓名等信息变更证明、企业经营情况证明等),除不可抗力的原因外,未在约定时间接受面谈或提交材料的,不予签发签证证件。
14.公安机关出入境管理部门做出的不予办理普通签证延期、换发、补发,不予办理外国人停留居留证件、不予延长居留期限的决定为最终决定。
四、办结时限
申请材料齐全后,15个工作日办结(情况调查时间除外)。
五、收费标准:
(一)一年以内有效期居留许可:400元;
(二)一年(含)至三年以内有效期居留许可:800元; 
(三)三年(含)至五年(含)有效期居留许可:1000元。
